From the 6th April 2016, the process for Flood Defence Consents (FDC) in England changed to the new Environmental Permitting Regulations (EPR) to allow a cohesive approach where the consenting process, and recommendations given, are the same across the board throughout England.

For new applications for works that are carried out in or near a main river or sea defence an EPR permit needs to be applied for under ‘flood risk activities’. There are some activities that are exempt and do not require a permit, providing the exempt activity is registered with the Environment Agency and you fully meet the conditions required for that exemption.
